Facebook Brings Down The Hammer Again: Cuts Off MessageMe's Access To Its Social Graph

messagemeMessageMe, an app that launched last week and raced up the charts to the #2 spot in social networking in the U.S., is confronting Facebook’s touchiness around access to its social graph. The app’s integration with Facebook stopped functioning earlier today (see left), the result of the company’s decision to cut MessageMe off from its “Find Friends” functionality, according to sources familiar with decision. MessageMe CEO Arjun Sethi declined to comment in this story and Facebook didn’t immediately respond to requests for comment. The move resembles Facebook’s decision last month to shut off Voxer’s access to the graph, even though Voxer connected to Facebook for well over a year. Voxer is another communications app that supports calling and voice chat. Facebook cut the app off around the same time that it launched competing functionality with free voice calling to other users. In that decision, Facebook cited Section 10 of its platform policy (which is the same one it’s using in MessageMe’s case): Reciprocity and Replicating core functionality: (a) Reciprocity: Facebook Platform enables developers to build personalized, social experiences via the Graph API and related APIs. If you use any Facebook APIs to build personalized or social experiences, you must also enable people to easily share their experiences back with people on Facebook. (b) Replicating core functionality: You may not use Facebook Platform to promote, or to export user data to, a product or service that replicates a core Facebook product or service without our permission. MessageMe apparently replicates too much of Facebook Messenger’s functionality for the company to be comfortable with it. Facebook has long been touchy about providing access to the biggest of its strategic competitors like Google and Twitter. Back in 2010, Twitter’s then-CEO Ev Williams griped about the company’s unwillingness to let Twitter users look up their Facebook friends on the service or to send Facebook updates to Twitter. In the same year, Google and Facebook had a back-and-forth over Facebook’s access to Gmail’s contact importer because the social network wouldn’t send data the other way. New beautifully colored long-horned beetle from Yunnan, China

The beetle family Cerambycidae, also known as long-horned beetles or longicorns, is characterized by emblematic extremely long antennae, which are usually longer than the total body length of the animal. The family is rather rich in diversity with more than 20 000 species known, distributed worldwide. Some representatives of these bizarre-shaped beetles, are also known as serious pests with their wood-feeding larvae causing extensive damage to living trees or untreated lumber. The beetles from this family are mainly associated with leaf litter habitats, where the specimens in this study were also collected.

The newly discovered species, Schwarzerium yunnanum, represents a remarkably engaging representative of the family with a blue-greenish beautifully colored body, and distinctive blue legs. A new subgenus, Rugosochroma, is also erected as a result of this recent discovery. The specimens examined were found in the Yunnan Province of China, where the name of the new species is derived from The study was published in the open access journal Zookeys.

Alongside the new species, seven known ones have been recorded from China for the first time. Among these are the very rare Aphrodisium tricoloripes, known only from China, Myanmar and Vietnam, as well as Chloridolum semipunctatum, so far exclusively found in Northern Laos.

All the species described, including the new one, belong to the subfamily Cerambycinae, which includes 750 genera in total. Within the long-horned beetle family, this remarkable biodiversity can be only rivaled by a single other subfamily Lamiinae, more commonly known as flat-faced longhorns.

The Galaxy S4 has everything for Mr. Generic - Crave - Mobile ...

The Samsung Galaxy S4 shows a different type of engineering--engineering for the masses. This reminds me of someone I work with--he is the world. What I mean is, he is Mr. Generic--his tastes mirror the world. He drinks wine and is sufficiently appreciative of it but he buys all sorts and isn't exactly a wine geek, but will buys wine aerator accessories and a super-expensive hydraulic cork remover. He prefers auto transmission cars, preferably the Direkt-Schalt-Getriebe type which has two clutches, with high-tech wizardry making shifts seamless and smooth. He likes a big turbo engine but never goes to the race track, never totally appreciative of the special skills required in track driving. He is the casual user for everything, so he is the world.

And he sings praises about the Samsung Galaxy S3, but no more, now it's the S4, with all the bells and whistles which geeks have been using all along, includingheart rate monitoring and being able to interface with weighing machines.

Obviously it must wow the world with an octa-core CPU, double the already overkill four cores in today's killer phones. The S4 even has a sensor to track your eye, and when you look away from the screen while watching a video, the video pauses. And if you move and gesture your hand, the page scrolls. It has a replaceable 2600mAh battery which is substantially bigger than the competition--a remarkable feat of engineering. In addition, it has the newest Corning Gorilla Glass 3 for its screen, a 5-inch full-HD display and a 13-megapixel camera which doesn't lose to the competition.

It is a phone which spec-based buyers like Mr. Generic would have no qualms buying. No matter how ugly it is, it would be his top choice. And the world's. It is truly the greatest phone the world has ever known, spec-wise. It has plucked all the fruits of greatest yield--LTE, big replaceable battery, a full-HD display. It has achieved every popular function a phone needs, and now even starts to take on questionably useful functions and markets them like they are the newest things in the world. Interfacing with weighing machines is no more innovative than Apple selling videoconferencing as Facetime.

Look at Mercedes Benz. After having everything destroyed during the war, it worked hard to build cars to sell to the world, especially to the US. The Mercedes Benz Ponton marked its true awakening--the first truly new chassis after the war, the precursor of the E-Class. This was Mercedes' S2. Then it made increasingly superb cars, all of them with well-engineered core car functions, until the Mercedes Benz 600--the behemoth of a car, the pinnacle of automotive achievement, with all the bells and whistles and the choice of all the popes, dictators, warlords, conmen and heads of state.

That Mercedes 600 is the Mercedes' S4.

The rest is history. Mercedes went on to sell stuff with great success, making feature-laden cars full of useless features not really related to the joy of driving, with the A class hamster-like car, C-class for aspirants, E-class for towkays who'd rather not make a choice and the S-Class for captains of industry and the CLS for men undergoing midlife crisis. Overall, a great success.

But the engineering for Mercedes changed from making great cars to great appliances. Appliances are cars made for Mr Generic, people who think themselves enthusiasts who aren't true petrol heads, but pore endlessly over spec sheets for number wars alone without any appreciation of whether it's truly a good car.

Great cars continued to be made by BMW, where Mercedes left off, but even BMW started making appliances, too. The last guy left standing is now Porsche, faithfully churning out light, reliable sports cars with race-proven engines. They are not terribly overpowered with great finesse in feel, weightage of controls, nimbleness and generally a great pleasure to drive. Porsche doesn't care that much for the spec sheet, with one of their best cars, the Cayman, being on the same power level as a Volkswagen Golf R, with a meager spec (there's the story of the Yamaha audio engineer who stepped into a Cayman and commented that the radio sounds like a postwar Sony transistor radio, but later switched off the radio commenting that in a Cayman, the engine is all the soundtrack he needs) but Porsche sell cars to people who really enjoy cars. Of course, Porsche sells automatic cars too, but at least the company sticks to its guns and keeps the manual cars available for the customers they really want.

For the auto guys, yes, there's Honda and Lotus but this is not an auto Web site and I've already written far too much about cars.

Samsung has made its last smartphone for enthusiasts today. The pinnacle of achievement. After this, everything would be an appliance.

I'm not about to buy the S4 because I need the OS from the source--so it's got be a Nexus. Why don't they just make a 8 core 5-inch LTE phone out of carbon fiber, with a big 3,000mAH battery, a 5-megapixel camera with big fat pixels for great low light performance instead of small little ones, with plain vanilla unadorned Android OS with no bloatware from the manufacturer? Is it that difficult? They'd save so much on the engineering and the company which makes it would be the next Porsche. I'd pay a big premium to the brave manufacturer simply because it dares to make something which even the great giant Samsung is afraid to.

So who will step up and make the Porsche of phones?

With their Ivy League pedigrees and East Coast addresses, Supreme Court justices often are rightly described as unrepresentative of the nation. But in one area, the justices look a lot like the rest of America.

"The diversity of the family lives of the justices mirrors the diversity of American families overall," said Andrew Cherlin, a Johns Hopkins University sociologist who studies families and public policy.

These varied family portraits of the justices are somewhat at odds with the arguments of gay marriage opponents who stress the unique ability of heterosexual couples to have babies as a reason to uphold bans on same-sex marriage.

The briefs defending California's Proposition 8 gay marriage ban and a federal law denying benefits to legally married gay couples are sprinkled with references to the ideal family as having a mother, a father, and biological children.

"Proposition 8 thus plainly bears a close and direct relationship to society's interest in increasing the likelihood that children will be born to and raised by the mothers and fathers who brought them into the world in stable and enduring family units," the provision's supporters say.

The conservative, public-interest Thomas More Law Center in Ann Arbor, Mich., puts it this way: "Reserving marriage to a man and a woman thus reflects the inherent distinction between those pairs capable of engaging in the act which can produce human offspring, and those pairs which cannot."

The two justices who have adopted children are considered likely votes against gay marriage. Chief Justice John Roberts is the father of two children, Jack and Josie, both 12. They were adopted four months apart as babies in 2000, after Roberts and his wife, Jane, then 45, spent several years trying to adopt. The Roberts family discussed the adoption for a biography of the chief justice that was aimed at young readers and published in 2006.

Justice Clarence Thomas and his wife, Virginia, took custody of Thomas's grandnephew, Mark, when he was 6, in 1998. Soon after they were married in 1987, the Thomases decided they would not have children of their own, author Ken Foskett wrote in his biography, "Judging Thomas." Mark's father had been in and out of legal trouble and his mother was raising three other children on her own. Thomas also has a biological child from his first marriage, which ended in divorce.

Justice Sonia Sotomayor also is divorced, while Justice Elena Kagan has never married. Neither has children.

Penney CEO emails suggest aim at breaking deal

(AP) ? It's been a tough week to be Ron Johnson.

J.C. Penney's CEO was in the hot seat again on Friday in New York State Supreme Court after facing investors this week over a dismal quarterly earnings performance.

This time he was being scrutinized by Macy's lawyers for a stack of emails that he wrote that they claim show he repeatedly pushed home diva Martha Stewart to try to break an exclusive deal with his rival so Penney could be the sole department store distributor of the domestic diva's goods.

"I need to propose a deal so she can go to Terry Lundgren at Macy's and break the agreement," according to one email Johnson wrote to an executive at Penney in August 2011.

Lundgren is CEO of Macy's.

Penney ended up signing a pact in December 2011 with Martha Stewart Living Omnimedia to open shops at most of its stores in spring 2013. But one month later, Macy's renewed its long-standing exclusive deal to sell some of Martha Stewart's products such as cookware and bedding. And then immediately sued Martha Stewart Living and Penney.

The trial, which began Feb. 20, focuses on whether Macy's has the exclusive right to sell some of Martha Stewart branded products such as cookware, bedding and bath items.

Macy's is seeking to block Penney from opening Martha Stewart mini shops in its stores. The shops are part of Johnson's big plan to reinvent the shopping experience at the beleaguered chain. The stakes are high for all three companies but particularly for Penney.

Penney's shares have now lost nearly 60 percent of their value since early last year when Johnson revealed his plan to scale back most sales in favor of everyday low prices. The stock drop is the latest indictment that Johnson's turnaround is failing Wall Street as much as on Main Street. Johnson is counting on the shops, particularly Martha Stewart's, to bring back shoppers who have fled to rivals like Macy's.

Johnson, who is expected to be questioned by Penney attorneys later Friday, acknowledged that getting a deal with Martha Stewart was critical and acknowledged that he knew the deal was exclusive with Macy's but stopped short in saying he wanted to break the exclusive. "I knew there had to be an amendment" to a deal between Macy's and Martha Stewart.

Johnson's appearance comes four days after Lundgren testified in court that the company had built the Martha Stewart brand to be the biggest name in home items since it began to start carrying the products in 2007.

Martha Stewart, who founded Martha Stewart Living, is expected to testify Tuesday.

Johnson's testimony marks a culmination of a legal battle between the three companies that started shortly after the Penney-Martha Stewart deal was announced in December 2011.

Macy's renewed its 2006 pact with Martha Stewart Living in January 2012 but then immediately sued the company, saying it breached a long-standing contract when it penned the 10-year deal with Penney. Penney also invested $38.5 million in a nearly 17 percent stake in Martha Stewart Living. In a separate lawsuit, Macy's sued Penney, claiming it had no regard for the Macy's contract and that Johnson had set out to steal the business that it had worked hard to develop.

Macy's also contends that Johnson "knowingly and purposely demanded and received confidential information" from Martha Stewart about the contract and crafted a deal that was more lucrative than the terms of the Macy's agreement.

The two suits were consolidated for the bench trial. Supreme State Court Judge Jeffrey Oing is presiding over the trial, which is expected to last three weeks.

Penney is aiming at what it believes is a loophole in the agreement between Macy's and Martha Stewart. It's a provision that allows Martha Stewart to sell goods in categories like bedding in Martha Stewart Living's own stores.

According to Martha Stewart, because the Macy's agreement doesn't say the goods under dispute can be sold "only in "stand-alone" stores, the mini shops within J.C. Penney stores do not fall under the exclusive agreement.

Macy's Inc., based in Cincinnati, disagrees. Lundgren argued that a typical definition of a store is that it has a parking lot, is part of a mall or has a sidewalk in front.

Macy's claims substantial damages and said the maneuver by Penney "threatens to inflict incalculable further harm on Macy's." The company claims that "billions of dollars of sales are involved."

But according to a memo filed by Penney, Macy's rights to Martha Stewart aren't nearly as sweeping as it suggests. Under Macy's interpretation of the contract, Martha Stewart Living is "little more than an in-house designer for Macy's," according to Penney.

Last summer, Macy's won a preliminary injunction against Martha Stewart Living that would prevent it from selling housewares and other exclusive products at Penney. Judge Oing granted Penney permission to open Martha Stewart shops, as long as the items under the exclusive contract with Macy's are not sold in them.

Penney plans to open shops featuring designs from Martha Stewart on May 1, but spokeswoman Daphne Avila said that the products like bedding that Macy's has deemed exclusive have been stripped of the Stewart name and instead feature the label "JCP Everyday." Window treatments and paper products like stationery, which are not included in the exclusive arrangement with Macy's, will bear Martha Stewart's name.

But Macy's is also trying to stop Martha Stewart from providing designs to J.C. Penney ? whether or not it gets rid of the Martha Stewart name.

The stakes are high for all three companies, but particularly for Penney.

Investors were bracing for a bad fourth-quarter report from Penney, but the staggering losses and revenue drops were far worse than feared.

Penney reported on Wednesday after the markets closed that its quarterly loss widened to $552 million, or $2.51 per share. Revenue fell 24.8 percent to $12.98 billion.

Results for the full year were even more jaw-dropping. For the fiscal year, Penney lost $985 million, or $4.49 per share.

Macy's, one of the best performing department stores, turned in a solid fourth quarter. Lundgren says home items a key business. Having another major department store sell Martha Stewart towels, pots and other merchandise could hurt its sales in that area.

For its part, Martha Stewart Living is trying to fatten merchandise revenue as it struggles to offset declines in its broadcast and publishing business, a segment that accounts for more than 60 percent of its business.

The stakes also are high for the personalities involved in the suit. Lundgren said that he hasn't spoken with the lifestyle guru since Dec. 6, 2011, when she called him to inform him that she signed a deal with Penney. The next day, Martha Stewart announced the deal to the public. Lundgren testified Monday that he was so shocked when Stewart told him that she had signed a deal, he hung up on her.

"I was completely shocked and blown away," he testified. "It was so far from anything I could imagine."

Bombs kill at least 22 in Iraqi capital

BAGHDAD (Reuters) - At least 22 people were killed in a series of blasts in Shi'ite neighborhoods of Baghdad on Thursday, police sources said, as Iraq's precarious sectarian balance comes under growing strain.

No one immediately claimed responsibility for the attacks, but Sunni Muslim insurgents have been redoubling their efforts to undermine the Shi'ite-led government and spark deeper intercommunal fighting since the start of the year.

Two car bombs, one parked near a crowded restaurant and the other close to a football stadium, exploded around sunset and killed at least 18 people in Baghdad's southern Shula district.

Violence in Iraq is increasing as Sunni opposition swells against Shi'ite Prime Minister Nuri al-Maliki, whose power-sharing government has been all but paralyzed since U.S. troops withdrew in December 2011.

Another car bomb and six roadside explosive devices planted at a market killed four other people in mainly Shi'ite Mahmoudiya, also in the south of Baghdad.

"I was inside my shop when the explosion happened," said photographer Ibrahim Jassam. "There were a groom and his bride preparing to have their wedding picture taken. They left everything and ran away after the blast. I hid in my shop."

A curfew was imposed on the area following the attacks.

Tens of thousands of Iraqi Sunnis have staged protests against Prime Minister Nuri al-Maliki's Shi'ite-led government in their western stronghold of Anbar on the border with Syria, and al Qaeda has urged them to take up arms.

Al Qaeda-linked militants appear to be regrouping in Anbar's caves and valleys, with some moving into Syria to join the fight against Assad, whose Alawite sect springs from Shi'ite Islam.

Iraq is calmer than in the communal bloodletting of 2006-2007, but Shi'ite leaders fear the war in neighboring Syria could push the country back towards sectarian strife.
